  12. Freeware Software is provided on an "AS IS" 
  13. basis, without warranty of any kind, including 
  14. without limitation the warranties that the 
  15. Software is free of defects, merchantable, fit 
  16. for a particular purpose or non-infringing. 
  17. The entire risk as to the quality and performance 
  18. of the Software is borne by you. Should the 
  19. Software prove defective in any respect, you and 
  20. not Licensor or its suppliers assume the entire 
  21. cost of any service and repair. In addition, the 
  22. security mechanisms implemented by the Software 
  23. have inherent limitations, and you must determine 
  24. that the Software sufficiently meets your requirements.

  27. LIMITATION OF LIABILITY. UNDER 
  28. NO CIRCUMSTANCES AND UNDER NO 
  29. LEGAL THEORY, TORT, CONTRACT, 
  30. OR OTHERWISE, SHALL LICENSOR OR 
  31. ITS SUPPLIERS OR RESELLERS BE 
  32. LIABLE TO YOU OR ANY OTHER PERSON 
  33. FOR ANY INDIRECT, SPECIAL, 
  34. INCIDENTAL, OR CONSEQUENTIAL 
  35. DAMAGES OF ANY CHARACTER INCLUDING, 
  36. WITHOUT LIMITATION, DAMAGES FOR 
  37. LOSS OF GOODWILL, WORK STOPPAGE, 
  38. COMPUTER FAILURE OR MALFUNCTION, 
  39. OR ANY AND ALL OTHER COMMERCIAL DAMAGES 
  40. OR LOSSES. IN NO EVENT WILL 
  41. LICENSOR BE LIABLE FOR ANY DAMAGES 
  42. IN EXCESS OF THE AMOUNT LICENSOR 
  43. RECEIVED FROM YOU FOR A LICENSE 
  44. TO THE SOFTWARE, EVEN IF LICENSOR 
  45. SHALL HAVE BEEN INFORMED OF THE 
  46. POSSIBILITY OF SUCH DAMAGES, OR 
  47. FOR ANY CLAIM BY ANY THIRD PARTY. 
  48. THIS LIMITATION OF LIABILITY SHALL 
  49. NOT APPLY TO LIABILITY FOR DEATH 
  50. OR PERSONAL INJURY RESULTING FROM 
  51. LICENSOR'S NEGLIGENCE TO THE EXTENT 
  52. APPLICABLE LAW PROHIBITS SUCH 
  53. LIMITATION. SOME JURISDICTIONS 
  54. DO NOT ALLOW THE EXCLUSION OR 
  55. LIMITATION OF INCIDENTAL OR 
  56. CONSEQUENTIAL DAMAGES, SO THIS 
  57. EXCLUSION AND LIMITATION MAY NOT

  61. HIGH RISK ACTIVITIES.  The Software is not fault-
  62. tolerant and is not designed, manufactured or intended 
  63. for use or resale as on-line control equipment in 
  64. hazardous environments requiring fail-safe 
  65. performance, such as in the operation of
  66. nuclear facilities, aircraft navigation or 
  67. communication systems, air traffic control, direct 
  68. life support machines, or weapons systems, in which 
  69. the failure of the Software could lead directly to 
  70. death, personal injury, or severe physical or 
  71. environmental damage ("High Risk Activities").
  72. Accordingly, Licensor and its suppliers specifically 
  73. disclaim any express or implied warranty of fitness 
  74. for High Risk Activities.

  77. TITLE. The Software is protected by copyright and 
  78. other intellectual property laws. Title and related 
  79. rights in the content accessed through the Software 
  80. is the property of the applicable content owner and 
  81. is protected by applicable law.

  84. U.S. GOVERNMENT END USERS.  The Software is a 
  85. "commercial item," as that term is defined in 48 
  86. C.F.R. 2.101 (Oct. 1995), consisting of "commercial 
  87. computer software" and "commercial computer 
  88. software documentation," as such terms are used in 
  89. 48 C.F.R. 12.212 (Sept. 1995). Consistent 
  90. with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 
  91. 227.7202-4 (June 1995), all U.S.  Government End Users 
  92. acquire the Software with only those rights set forth 
  93. herein.
